RENOUVELLEMENT de la PERIODE D'OBSERVATION (Article L.622-9 du Code de Commerce)
Par jugement du 29/01/2026 le Tribunal de Commerce de céans a ouvert une procédure de redressement judiciaire à l'égard de l'entreprise B.H PLOMBERIE CHAUFFAGE CLIMATISATION (SARL) sise, [Adresse 2] (RCS CHALON sur SAONE 884 203 274 ), et a ouvert une période d'observation jusqu'au 29/07/2026 prévue à l'article L. 621-3 du Code de Commerce.
L'affaire a fait l'objet d'un renvoi à l'audience de ce jour afin de vérifier le niveau d'activité de l'entreprise et sa capacité financière ; le débiteur, le représentant des salariés et le mandataire judiciaire ont été convoqués à cette même audience.
La société B.H PLOMBERIE CHAUFFAGE CLIMATISATION (SARL), représentée par [F] [E], responsable légal de la société, a comparu à l'audience de ce jour ; il sollicite la poursuite de la période d'observation.
SAS [O] représentée par Me [O], mandataire judiciaire, a été entendue en ses observations ; ce dernier déclare ne pas s'opposer à la poursuite de la période d'observation.

MOTIFS DE LA DECISION :
L'affaire revient en cours de période d'observation, dans le cadre d'une audience intermédiaire, afin de vérifier le bon déroulement de la procédure et, notamment, afin de permettre au débiteur de communiquer au Tribunal ses résultats d'exploitation, sa situation de trésorerie et de justifier de sa capacité à faire face aux dettes mentionnées au I de l'article L.622-17 du Code de Commerce.
Le débiteur à l'audience produit des éléments susceptibles d'établir que l'activité se poursuit dans des conditions satisfaisantes permettant ainsi d'envisager l'élaboration d'une solution à la procédure de redressement.
Il convient en conséquence d'autoriser le renouvellement de la période d'observation en application des dispositions de l'article L.621-3 du Code de Commerce dans les termes ci-après.
PAR CES MOTIFS :
Le Tribunal, après en avoir délibéré conformément à la Loi, statuant publiquement et sur requête ;
Le Ministère Public avisé de la présente audience ;
Entendu le mandataire judiciaire en ses observations ;
Vu les dispositions de l'article L. 621-3 du Code de Commerce ;
Autorise le renouvellement de la période d'observation de B.H PLOMBERIE CHAUFFAGE CLIMATISATION (SARL), ci-dessus identifiée, qualifiée et domiciliée jusqu'au 29/01/2027 ;
Dit que l'affaire reviendra pour examen à l'audience du 27/08/2026 et précise que cette date d'audience est communiquée aux parties ce jour ;
Invite le débiteur à produire pour la prochaine audience au tribunal ainsi qu'au mandataire judiciaire par transmission au greffe 48 heures avant le jour de
