Attendu qu'aux termes de l'article 384 du code de procédure civile, en dehors des cas où cet effet résulte du jugement, l'instance s'éteint accessoirement à l'action, notamment par l'effet du désistement d'action, lequel est parfait dès la volonté de manifestation du renonçant, sans que la partie adverse ne puisse s'y opposer ;
Attendu, en l'espèce, que le demandeur requiert du tribunal qu'il prenne acte de son désistement d'action, lequel est accepté par le défendeur ;
Attendu que le désistement d'action doit être déclaré parfait et qu'il convient d'en donner acte ;
PAR CES MOTIFS
Le tribunal statuant en dernier ressort, assisté du greffier,
Vu les articles 384 et suivants du code de procédure civile,
Constate la réalité de l'offre de désistement d'action du demandeur ;
Donne acte aux parties du désistement d'action du demandeur, entraînant abandon de son droit ou de sa prérogative revendiquée dans le cadre de la présente affaire ;
Se déclare dessaisi à compter de ce jour ;
Laisse au demandeur la charge des dépens, faute d'accord contraire des parties, dont ceux de greffe liquidés à la somme de 75,03 euros TTC ;
Ainsi fait et prononcé à l'audience publique du tribunal de commerce d'Aubenas.
